These are The Fragrance Shop terms and conditions of sale.


Delivery

You need to report to us within 10 days of dispatch if your item has not been received to enable us to investigate the matter with our couriers. Failure to do so will prevent us from resolving the issue for you.

We use the Royal Mail Tracked delivery service.  Standard Delivery in the UK takes 2-3 working days. Orders are usually dispatched within 1 working day of being placed. See our  delivery page for up to date details of our expected order fulfilment time.  Our address labels are created automatically based on the address which you enter.

The Royal Mail delivery service that we use classifies UK destination parcels which take over 5 working days from the day of dispatch for delivery as "Delayed". At this time, please continue to wait for your order as it is likely that it will arrive shortly. After 15 working days from the day a UK destination parcel is dispatched, an order is considered by the Royal Mail as "Lost". In the unlikely event this occurs, please inform us and you will either receive a full refund or the option to have your goods dispatched to you again.

UK Next Day Delivery can be ordered up until 5pm GMT Monday to Thursday for delivery to a UK address the next working day. Please note Next Day Delivery cannot be delivered on a Saturday; any UK Next Day Delivery orders placed after 5pm GMT Thursday will be delivered the following Monday. Furthermore we cannot deliver on UK Bank Holidays; please plan accordingly and check our Delivery page for more information on UK Bank Holidays.

UK Next Day Delivery to the British Highlands, Islands and Northern Ireland has a delivery estimate of 2 days and cannot be delivered on Saturdays.

During periods of severe weather conditions (floods, gales and snow) all of our delivery methods may take longer than expected. In these circumstances, we aim to keep our customers abreast of the situation and will amend our delivery estimates accordingly. However we advise all of our customers to plan their orders with plenty of time, especially when forces beyond our control come in to play.

 

Delivery Charges

Within the UK, delivery is FREE on all orders over £40 and £2.99 for orders under £40. Orders over £60 are elegible for Free UK Next Day Delivery (standard price £3.99) and orders of any amount are free when ordering via our Click and Collect service.

We currently deliver to UK addresses and also various international desinations.

Re-Delivery Charges

Please ensure that the delivery address you enter is correct. Goods that are returned to us will incur a further delivery charge.

 

Temporarily Out of Stock Items

We update our web site regularly with stock that we have available however, if you order an item and it is out of stock (may be due to unprecedented demand) then we will refund you the amount for the item and any associated services such as delivery or gift wrapping.

If you order multiple items and some items are temporarily out of stock (may be due to unprecedented demand) then we will send you the items that are currently in stock and refund you the amount for the items not currently in stock.

 

Try It First

Try it First gives you the confidence to try new fragrances!

When you purchase any fragrance online with the Try It First logo, your order will arrive with a free sample vial of the same fragrance. Take a sniff... Love it? That's great news, finish the sample and move on to your full-size fragrance. If not, no problem! Return the unopened full size bottle with the enclosed returns note (please retain proof of postage) and we will refund you as soon as we receive the item. 

 

Outlet Stores

All Fragrance Shop Outlet stores are not able to be selected for Click & Collect destinations. Outlet stores can be identified by the store name in our store finder.

Outlet stores are also exempt from Happy Hour promotions that are running online and in our standard The Fragrance Shop stores.

 

Returns Policy

You are responsible for checking that goods are correct when you receive them without opening them or removing the cellophane wrapper.

If you receive an item that is faulty or incorrect, you must notify us within 7 working days. We will repair or replace the goods or refund your payment, as appropriate.

You must retain all original packaging, including outer packaging, to use if returning the goods. If the goods are incorrect you must return them without removing the cellophane wrapper.

Cancellation of Your Order

You have the right to cancel your order within 7 days of receipt of goods. This cancellation period commences the day after the day you receive the goods.

To cancel your order, please write a letter or send an email stating that you wish to exercise your right to cancellation, including your full name, address, and order number. Your item must be re-packaged securely and sent so that it reaches us within seven working days of the date that your order was delivered to you.

Please note that you will be responsible for the costs of returning the goods to us unless we delivered items to you in error or the item is faulty. If you do not return the item within seven working days, we may arrange for collection of the item from your residence at your cost.

If you cancel your order after the delivery process has started you will be liable for any services included in the order such as postage & packing and/or gift wrapping. Upon receipt of notice of cancellation, we will refund the relevant part of the purchase price for the products in your order within 30 days.

 

Customs and Import Duties

When ordering goods for delivery overseas, your order maybe subject to import duties and taxes which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you.

Please note that you are considered the importer and must comply with all laws and regulations of the country in which you are receiving the goods.

International deliveries are subject to opening and inspection by customs authorities.

 

Undelivered Items

If an item fails to arrive with you after being dispatched by ourselves we have to wait 15 working days (10 working days for next day delivered items) from the date of dispatch before we can offer a refund or redelivery of that item.

This is due to the fact the Royal Mail will not consider an item lost until this point, so it is still likely that the item will still arrive.

If the item doesn't arrive within this period, we will ask you to sign and return a form confirming that you have not received your order before we process a refund or a redelivery.

Please note that any non delivered items must be reported to us in writing or email within 10 days of despatch. Any issue repotred to us outside of this time period will not be able to be refunded or replaced.

 

Vouchers, Promotions and Competitions

From time to time, we (or selected third parties) may include competitions, promotions, vouchers or other offers on the website. Each such offer and or voucher shall be subject to its own express terms, however, each offer or promotion will be subject to availability at all times, and cannot be used in conjunction with any other voucher or offer. Your statutory rights are not affected.

Coupons, discounts and promotional discount codes offered in The Fragrance Shop stores are valid only for use as part of a purchase made in our stores, unless otherwise stated.

Voucher codes and promotions cannot be used against Discovery Club orders.

 

Website Images, Descriptions and Pricing

We undertake all reasonable care to ensure that all the details, prices and descriptions of website products are accurate at the time when the appropriate information was entered onto our system.

Whilst we endeavour to keep the website as up-to-date and accurate as is possible, there may be rare occasions when the information on the website (including product descriptions, stock and pricing) at a certain time may not reflect the position exactly at the point an order is placed.

Free gifts with purchase are subject to availability. On rare occasions, free gifts may be advertised when they are no longer available. In these instances, we reserve the right to offer no replacement item.

All product photography is for illustrative purposes only, and the actual item may vary in colour, design and product size.

 

Formation of a Binding Contract

The Fragrance Shop considers an order to be a binding contract from the point of that order being dispatched to you from our warehouse. Until that point we reserve the right to cancel the contract at any time. If we chose to end this contract we will notify you in writing as soon as possible and refund any transactions within 7 working days.

 

Bulk Orders

Our agreements with the major brand houses include clauses where we agree not to sell fragrance on for the purpose of resale. Where we suspect that customers are buying large numbers of items for the purposes of reselling them, we reserve the right to cancel these orders at any point up the item being dispatched.

 

Free Samples with Online Orders

We endeavour to provide free samples with orders placed via the website. It may be the case however, for some delivery methods such as 'Click & Collect'', the sample vials may be exchanged for alternative sampling experiences in store on collection.

 

Discovery Club

The subscription to the Discovery Club consists of an initial charge followed by recurring period charges. By entering into this Agreement, you acknowledge that your subscription has an initial and recurring payment feature and you accept responsibility for all recurring charges prior to cancellation. The Fragrance Shop will submit periodic charges (e.g., quarterly) without further authorization from you, until you provide prior notice that you have terminated this authorization.

By subscribing to The Discovery Club you are agreeing to pay recurring periodic subscriptions for an indefinite time until cancelled by you or us. You can cancel your subscription at any time. You will not be charged for any cancellation. You can re-subscribe at any time following your cancellation.

We reserve the right at our absolute discretion not to renew your subscription at any time without giving any reasons for our decision.

Voucher codes, promotions and discounts do not apply to Discovery Club orders.

To be eligible to purchase an online refill, you must first own a refillable bottle. The refill of bottles is undertaken in our warehouse and requires the customer to send their empty refillable bottle to The Fragrance Shop. If customers do not own a refillable bottle they can purchase one here >

After purchasing an online refill of Thierry Mugler Source Eau de Parfum Alien or Angel, our Customer Care team will be in touch with you either over the telephone or via email to let you know the process, which is as follows:

- Receive a free Collect+ returns label to affix to your package from our Customer Care team via email. This entitles you to return your bottle to The Fragrance Shop for free.
- Carefully package your empty refillable bottle of Thierry Mugler Angel or Alien Eau de Parfum in a sturdy cardboard box
- Send package to our head office address, of which our Customer Care representative will inform you
- Upon receiving your empty refillable Thierry Mugler Eau de Parfum bottle, we will refill, process payment of your order and return your refilled bottle along with any other items in your order

NB your order total will include the cost of the refill, any other items in your order, and the cost of delivering your order. If the order total amounts to more than £40, there will be no cost chargeable to you for delivery. If your order consists of other items as well as the refill, please note that these items will not be dispatched until we receive your refillable Thierry Mugler Eau de Parfum bottle to refill.

We cannot accept any responsibility if the bottle is damaged in transit. We also offer the refill service instore. Simply take your refillable bottle to The Fragrance Shop, pay for a refill and it will be refilled while you wait. To find your nearest store, Click Here >

Collect+

The Fragrance Shop now works with the fantastic Collect + service – where you can order online and get your order delivered to one of 5,500 local participating stores around the UK. This means you won’t have to wait around at home for your delivery or ask a neighbour to accept your order – simply pick up from your local store at a more convenient time, for the low price of £3.99.

To collect your order from a participating Collect+ store, you'll need a form of ID and your Collect+ Tracking Number which will be emailed or texted to you after ordering.

Please note that if you would like someone else to collect the parcel on your behalf, they will either need proof of your identity or identification with the same surname as yours.

Your chosen store will keep your order for up to 10 days. If you haven’t collected your order by then, the order will be returned to The Fragrance Shop and we will refund the cost of the order minus a further £3.99 to fund return delivery cost. 

Costs

Collect + delivery costs £3.99 and will arrive the next working day. 

We send all Collect + orders to stores via our Next Day Delivery service, meaning your local store will receive your order tomorrow (if you order before 2pm Mon-Fri).

If you order after 2pm Mon-Thurs your parcel will arrive in store the day after tomorrow.

If you order after 2pm Friday or at any time on Saturday or Sunday, your parcel will arrive in store on Tuesday.

Please take into account that we are unable to deliver on Bank Holidays so please allow an extra working day for this.NB Collect + Delivery to the British Highlands, Islands and Northern Ireland have a delivery estimate of 2 days and cannot be delivered on Saturdays. 

 

Win a year’s supply of fragrance

Entry to the prize draw is automatic for anyone signing up to our email newsletter either via the website or at the till point in store during purchase.

Prize draws are run on a monthly calendar basis, and by signing up in a calendar month you will be entered into the prize draw for that month.

Entrants must still be signed up to The Fragrance Shop's email newsletter at the end of the prize draw to be eligible to win.

Entry to the prize draw is free. Employees of The Fragrance Shop and their families, or anyone professionally connected with the prize draw, are not entitled to enter. If you are eligible and resident in the UK, you may enter without making any purchase by hand-writing clearly and legibly in block capitals on a piece of plain paper, your name and address and postcode, before signing and sending it in a properly stamped, handwritten envelope addressed to:- "No Purchase Necessary”, The Fragrance Shop, Win a Year’s Supply of Fragrance, The Fragrance Shop, Churchill Point, Lake Edge Green, Trafford Park, M17 1BL. You must include a properly stamped handwritten self addressed envelope.

An independent person, selected by The Fragrance Shop, will randomly select the winner after the end of the month from all valid entries. The winner of the prize will receive: 2 x 75ml-100ml bottles of fragrance of the winner’s choosing. The winner will be notified via email within 7 days of the draw date. This must be acknowledged by the winner, within 7 days. Failure to respond to this email means an alternative winner will be selected from all the valid entries received. The winner may be announced via The Fragrance Shop’s social media accounts, or within The Fragrance Shop’s email newsletter.

Responsibility will not be accepted for loss, delay, or damages to prizes whilst being delivered. There is no cash alternative to the stated prize.

The Fragrance Shop reserves the right to substitute any of the products listed for ones of similar market value. The Fragrance Shop reserves the right to amend and/or withdraw the competition at any time without prior notice.

The Fragrance Shop – Happiness Scratchcards 2014 Promotion

Terms & Conditions

  1. PARTICIPANTS
    You must be aged 18 or over and a UK resident to participate in the Happy Week Scratchcard Promotion ("Promotion"). The following are not eligible to participate: (i) Employees and immediate family members of employees of The Fragrance Shop ("the Promoter"), any company responsible for redemption of prizes/vouchers or for supplying prizes for the Promotion and their respective franchisees, subsidiaries, agents and advisors, (ii) other persons assisting with this Promotion, (iii) any person not being an individual person, (iv) any syndicate or collection of persons acting in concert, and (v) any person entering via an agent or using the services of or which is an entity carrying on the business of entering (or advising on entering) prize promotions.

 

  1. DURATION
    Participation in the Promotion is scheduled to take place from 22nd – 31st August 2014 (inclusive) at The Fragrance Shop and www.thefragranceshop.co.uk in the United Kingdom.

 

  1. HOW TO ENTER

    3.1 How to Obtain Happiness Scratch card (“Scratch Card”)
    Whilst stocks of Scratch Cards at The Fragrance Shop last, obtain a Scratch Card when you spend £10 or more during the Promotion at The Fragrance Shop store. Strictly one scratch card will given with purchases of £10 or more. Only one Scratch Card per customer per visit. The promoter will not allow purchases to be split into smaller denominations to gain additional Scratch Cards.   

    3.2 How to Win:-
    3.3.1 Simply scratch of the panel on the front of the Scratch Card to reveal your prize. Prize Descriptions and Conditions below which corresponds with the prize description appearing on that Scratch Card.

Please refer to the "How to Claim" section below to claim your prize.
Please take care not to damage your Scratch Card - it will become void if you do.

3.4 No Purchase Necessary
If you are eligible and resident in the UK, you may obtain a Scratch Card without making any purchase by hand-writing clearly and legibly in block capitals on a piece of plain paper, your name and address and postcode, before signing and sending it in a properly stamped (franking is not acceptable), handwritten envelope addressed to:-

You must include a properly stamped handwritten self addressed envelope.

The Promoter will not process any application:

  • received before Friday 22nd August 2014, or
  • received more than 3 working days after the last date of the Promotion closing date which Sunday 31st August 2014, or
  • for more than one item at a time per envelope, or
  • multiple applications from the same person or household, or  
  • if not strictly in accordance with the requirements in this section.

3.5 Distribution of Scratch Cards
3.5.1 Distribution Procedure For Scratch Cards for all Prizes:
All Scratch Cards have been distributed by the Promoter on a random basis amongst participating Fragrance Shop Stores and the No Purchase Necessary address.

4.2 Further Prize Details and Conditions

Voucher-prizes are not for use in conjunction with any other promotion or offer (including other price reductions) and discounts are valid against the full, pre-discounted and pre-postage and packing, retail price at the time of redemption. Online redemptions will require registration and use of a valid credit or debit card from a selected range (unless additional methods are also specifically stated below).

5.3 FREE Branded Gift prize (In store only)
Each FREE branded gift voucher entitles the winner to a FREE branded gift from a selection available in store at time of next purchase when you spend £20 or more at The Fragrance Shop store only on your next purchase.


The voucher-prize can be used for one single transaction by redeeming in-store only. See ‘How To Claim’ section below. Voucher expires 14th Sept 2014

Conditions Applicable to All Prizes
Prizes may not be exchanged for any cash or other alternative and prizes are not transferable, divisible, permitted to be sold or resold. The Promoter shall be under any obligation to enquire whether the person submitting any Scratch Cards is the person entitled to make the claim, irrespective as to whether or not that person first obtained that Scratch Card (but without affecting the Promoter’s rights in relation to anyone in breach of the Rules). All Stickers must be submitted and will be retained upon redemption, except for any Scratch Card which is an instant win Voucher and redeemed online.

All advertisements depicting the prizes and prize descriptions are illustrative rather than definitive. Any advertisement of the cash value of the prize-pool represents the Promoter’s best estimate of the normal retail-price or (in the case of voucher-prizes) of the discount offered (based in turn on the average discount if variable) for all prizes which are available to win; it does not thereby imply that any prize will be awarded in the absence of a corresponding valid claim. Reproduction of any prize-imagery does not thereby imply any endorsement or association by the producer of that prize-type nor by the owner of any brand associated with that prize-type.

All un-awarded or unclaimed prizes will lapse if not the subject of valid claims and the award of which has been completed within the time limits as prescribed by these Rules and in any event by 14th Sept 2014 at the latest (unless otherwise specifically stated). Ownership of prizes pass from the relevant prize supplier direct to winners and not via the Promoter.

 

  1. RESPONSIBILITY
    To the fullest extent permitted by applicable law (but not otherwise) the Promoter and its agents assume no responsibility and are not liable for:- (i) the accuracy or otherwise of the prize description or illustration, (ii) the non-availability, loss, interception or interference with, late or non receipt or damage of or to any entry, prize claim, Happiness Scratch Card, voucher-prize, voucher, prize or notification or other communication, (iii) (other than those warranties or conditions implied by statute and which cannot be excluded by the Promoter) any representation, warranty, condition or guarantee in respect of a prize, (or (iv) any actual or perceived loss of opportunity or damage arising in connection with the termination or suspension of the Promotion (or any part, feature or element of the Promotion) at any time if due to supervening circumstances beyond the Promoter's control (although The Fragrance Shop will still honour any valid claims received prior to the termination or suspension).


  2. THE PROMOTER'S RIGHTS
    The Promoter may (i) extend any time limit or waive any of the Rules where a person might otherwise have been disqualified or otherwise disadvantaged (without obliging the Promoter to relax the Rules on any further occasion for that entrant or at all for any other person), (ii) terminate or suspend the Promotion (or any part, feature or element of the Promotion) at any time due to supervening circumstances beyond the Promoter's control including (without limit) those which the Promoter determines have or are likely to compromise the security or credibility of the Promotion (or the affected part, feature or element of it). The Promoter's decision in the exercise or interpretation of any of its rights or discretions in connection with these Rules shall be final and binding

 

  1. PRIVACY POLICY
    In administering this Promotion, the Promoter may collect personal information from you and, unless it has first obtained your consent, the Promoter (i) will not collect more of your personal information than it needs for the purposes of administering and analyzing this promotion securely, lawfully and efficiently and of carrying out publicity as stated in these Rules, (ii) will only use your personal information for that purpose which may include transferring your personal information to its associates and (if relevant) to any partner of the Promoter responsible for fulfilling your prize, and (iii) will not transfer your personal information outside the European Economic Area unless it is permitted to do so under the Data Protection Act 1998.

    If entrants select the opt-in feature to receive marketing communications from the Promoter when making an entry, omission to opt-in again when making a subsequent entry does not represent a valid request to opt-out of receiving those communications; entrants who wish to opt-out having previously opted-in at the time of an earlier entry must follow the instructions on the website to opt-out of receiving those communications.

    Any enquiries about the personal information collected from you for this Promotion should be submitted in writing and sent by pre-paid post to The Fragrance Shop, Web Division, Unit 6, Premier Park, Acheson Way , Trafford Park, Manchester, M17 1GA marking your envelope "Data Protection Request – Happiness Scratch Card" by 14th Sept 2014.

 

  1. GENERAL
    All instructions, rules and conditions on any advertising or promotional materials relating to this Promotion form part of the Rules although, in the event of conflict, these provisions shall prevail over all such other instructions, rules and conditions. Expressions which have been defined above shall have the same meanings when used in such other instructions, rules and conditions wherever the context admits. No claim under or participation in this Promotion or any Happiness Scratch Card is valid in combination with any other offer or promotion, save to the extent expressly stated herein.

    The Promoter and/or the Partner may carry out such background checks and require such information (in addition to the information required to be given on entries or prize claims) as they consider necessary or desirable for the purposes of verifying any entry or claim and an entrant's/claimant's compliance with the Rules and any prize may be withheld unless and until the Promoter and the Partner is satisfied with the verification.

    Should the Promoter determine based on the evidence in its possession (and in the Promoter's sole opinion) at any given time that (i) any entry is incomplete, damaged or unreadable or is made by an ineligible person (ii) any entry or entrant fails to comply with any of these Rules or (iii) any person is misusing or tampering or attempting to misuse or tamper with the proper conduct of the Promotion, then the Promoter may adjudge (in its sole discretion) that such entrant is ineligible to take part in this Promotion and every other promotion or offer of the Promoter and every entry, claim and request by that entrant then in process shall be invalid and have no force or effect so that The Fragrance Shop is entitled to disregard them all.

    The ‘scratching’ off of any panel covering a ‘prize’ amounts to acceptance of the Rules and to their respective interpretation under English law and by the English courts and of the terms of the following licence:

    You understand and accept that (i) the Promoter retains ownership of all Happiness Scratch Cards and ownership or control of the trade marks and other intellectual property in and over the Happiness Scratch Cards and all Promotion-advertising at all times ("the Property"), (ii) the Promoter grants you a licence to use the Property solely for the purposes of the proper participation in the Promotion in accordance with the Rules, (iii) none of the following shall be considered proper participation in the Scheme, namely; any sale, offer to sell, giving away or other dealing with any Happiness Scratch Card, any use for any purpose whatsoever of any Promotion advertising or any feature taken from it or anything which is a breach by you of the Rules (iv) you may not assign this licence or any benefit under it, (v) any use of the Property for a purpose not stated to be permitted or any failure otherwise to observe any provision of this licence shall result in automatic termination of the licence without requirement as to notice and amount to an irremediable infringement of the Promoter's intellectual property entitling the Promoter to all rights and remedies available by law, and (vi) following termination or expiry of this licence you will return all Happiness Scratch Cards to the Promoter without attempting to redeem the same and shall cease to use the Property for any purpose whatsoever.

    All age limits shall be deemed to be actual age as at the time of acceptance of the Rules, unless expressly stated otherwise in these Rules.

    Any Happiness Scratch Card or prize claim will be void if it is deemed by the Promoter to be damaged, counterfeit, a photocopy, incomplete or illegible or if it has been handled (including offering for sale) or an entry or claim made in respect of it by an ineligible person.

    The Promoter may (in its sole discretion) decline to enter into any correspondence save as otherwise stated in these Rules.
