1. These terms
1.1 What these terms cover. These are the terms and conditions on which we supply goods to you.
1.2 Why you should read them. Please read these terms carefully before you submit your order to us. These terms tell you who we are, how we will provide goods to you, how you and we may change or end the contract, what to do if there is a problem and other important information.
2. Information about us and how to contact us
2.1 Who we are. We are TFS Buying Limited a company incorporated in England and Wales, under company registration number 06789840 with our registered office at Churchill Point, Lake Edge Green, Trafford Park, Manchester, M17 1BL.
2.2 How to contact us. You can contact us by telephoning our customer service team at +44 (0) 161 468 1701 or by writing to us at email@example.com.
2.3 How we may contact you. If we have to contact you we will do so by telephone or by writing to you at the email address you provided to us in your order.
2.4 'Writing' includes emails. When we use the words 'writing' or 'written' in these terms, this includes email but not fax.
2.5 “Working day” means Monday to Friday on any day which is not a bank or public holiday in the UK.
3. Our contract with you
3.1 Price. The prices payable for goods that you order are as set out in our website. You will be required to pay extra for delivery and it might not be possible for us to deliver to some locations. Our delivery charges are set out in our website.
3.2 How we will accept your order. Our acceptance of your order and formation of a binding contract occurs when we dispatch your order from our warehouse. If we choose to end this contract, we will notify you in writing as soon as possible and refund any transactions within 7 working days.
3.3 If we cannot accept your order. If we are unable to accept your order, we will inform you of this in writing and will not charge you for the goods. This might be because the goods are out of stock, because of unexpected limits on our resources which we could not reasonably plan for, because we have identified an error in the price or description of the goods or because we are unable to meet a delivery deadline you have specified.
3.4 Bulk Orders. Our agreements with the major brand houses include clauses where we agree not to sell cosmetics and fragrance on for the purpose of resale. Where we suspect that customers are buying large numbers of items for the purposes of reselling them, we reserve the right to cancel these orders at any point up to the item being dispatched. Due to this restriction, we reserve the right to cancel any orders of 5 or more units.
3.5 Free Samples with Online Orders. Some goods (e.g. fragrance) may contain free samples with orders placed via our website. It may be the case however, for some delivery methods such as “Click & Collect'', that sample vials may be exchanged for alternative sampling experiences in store on collection.
3.6 Gift Cards and E-Gift Cards - activated gift and e-gift cards can be redeemed in full or part payment for any goods in The Fragrance Shop stores or online, subject to the following terms:
(a) the Gift Card or E-Gift Card cannot be exchanged for cash or any other vouchers, and cannot be re-sold;
(b) the balance of your Gift Card or E-Gift Card can be checked in-store or online;
(c) no change will be given as part of a Gift Card or E-Gift Card transaction, but any remaining balance can be used for future purchases;
(d) in the event that the balance on the card is not redeemed after 12 consecutive months the Gift Card or E-Gift Card will automatically expire and the remaining balance will be cancelled;
(e) The Fragrance Shop will not be responsible if an incorrect email address is submitted at the time of purchasing a Gift Card or E-Gift Card. If the Gift Card or E-Gift Card you purchase is sent to someone else, it will not be replaced, or its value refunded;
(f) The Fragrance Shop cannot replace or reimburse the Gift Card or E-Gift Card if it is lost or stolen;
(g) you are not able to top-up an existing physical Gift Card online (this must be done in-store) and expired or de-activated cards cannot be re-used;
(h) in the event you would like to cancel an order where you have used a Gift Card or E-Gift Card as payment or you have any questions or concerns please contact our customer services team.
(i) when you buy product(s) online using an E-Gift Card (for the full order amount), after you have returned the product(s) by post, your refund will be credited to a new E-Gift Card and not by any other payment method e.g. cash or bank transfers. Please check our Returns policy for more information on how to return product(s);
(j) if you buy product(s) online for more than the value of the Gift Card or E-Gift Card and pay part of the amount using a Gift Card or E-Gift Card and pay the remainder using an alternative payment option, then after your item has been returned via post, the amount you paid via the Gift Card or E-Gift Card will be credited to a new Gift Card or E-Gift Card and not by any other means e.g. cash or bank transfers. The amount you paid using the alternative payment option will be credited using that same payment method;
(k) we do not allow payment for Gift Cards or E-Gift Cards by Klarna, PayPal Credit or Apple Pay;
(l) Gift Cards or E-Gift Cards cannot be used in conjunction with any other discount or promotion online at the time of purchase.
3.7 Discounting. Please check the separate terms and conditions supplied with the individual codes. Please be aware that all Creed, Acqua Di Parma, Escentric Molecules, BaByliss, GHD, SOSU By Suzanne Jackson, The Ordinary, Barbour 100ml EDT, FCUK Anniversary, The IKON collection bundle, Lord & Berry, Aromatherapy Associates, Brushworks, Nailberry, Look Good Feel Better, Lola Make Up, Dr Botanicals, FCUK Anniversary, Indulge Beauty Outlet products, Discovery Club offers are excluded from all discount codes and special offers. 3.12 We reserve the right to amend these terms and conditions from time to time. Any change will be notified on our website.

4. Your rights to make changes
4.1 If you wish to make a change to the goods you have ordered please contact us. We will let you know if the change is possible. If it is possible we will let you know about any changes to the price of the goods, the timing of supply or anything else which would be necessary as a result of your requested change and ask you to confirm whether you wish to go ahead with the change. If we cannot make the change or the consequences of making the change are unacceptable to you, you may want to end the contract.
4.2 We undertake all reasonable care to ensure that all the details, prices and descriptions of website goods are accurate at the time when the appropriate information was entered onto our system (E&OE).
4.3 Whilst we endeavour to keep the website as up-to-date and accurate as is possible, there may be rare occasions when the information on the website (including descriptions, stock and pricing) at a certain time may not reflect the position exactly at the point an order is placed.
5. Temporarily Out of Stock Items
5.1 We update our web site regularly with stock that we have available however, if you order an item and it is out of stock (may be due to unprecedented demand) then we will refund you the amount for the item and any associated services such as delivery or gift wrapping.
5.2 If you order multiple items and some items are temporarily out of stock (may be due to unprecedented demand) then we will send you the items that are currently in stock and refund you the amount for the items not currently in stock.
6.1 Delivery costs. These are clearly listed on our Delivery page and at the checkout (before your order is completed).
6.2 We currently deliver to UK addresses and also various international destinations. If you would like to find out more information on our delivery times/cut-off times, charges and destinations please visit our Delivery page.
6.3 When ordering goods for delivery overseas, your order maybe subject to import duties and taxes which are levied once the package reaches your country. Any additional charges for customs clearance must be borne by you. International deliveries are subject to opening and inspections by customs authorities.
6.4 Sometimes there are events that occur that are outside of our control, this could be due to periods of severe weather conditions (e.g. floods, gales and snow), substantial increase in demand for our products or any other event we cannot predict or control. During these times, all of our delivery methods may take longer than expected. In these circumstances, we aim to keep our customers abreast of the situation and will amend our delivery estimates accordingly. However, we advise all of our customers to plan their orders with plenty of time, especially when forces beyond our control come in to play. If our supply of the goods is delayed by any event outside of our control then we will contact you as soon as possible to let you know and we will take steps to minimise the effect of the delay. Provided we do this we will not be liable for the delays caused by the event, but if there is a risk of substantial delay you may contact us to end the contract and receive a refund for any goods you have paid for but not received.
6.5 If you are not at home when the goods are delivered. If no one is available at your address to take delivery and the goods cannot be posted through your letterbox, we will leave you a note informing you of how to rearrange delivery or collect the goods from a local depot. Goods that are returned to us will incur a further delivery charge.
6.6 If you do not re-arrange delivery. If after a failed delivery to you, you do not re-arrange delivery or collect them from a delivery depot we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery we may end the contract.
6.7 Accuracy of delivery details. Please ensure that the delivery address you enter is correct as we will not be liable for failed delivery due to inaccurate information provided by you.
7. Our 90 day returns policy
7.1 You can return any goods to us within 90 days of purchase. If you change your mind, or if you receive an item that is faulty or incorrect, please notify us as soon as possible, in any event no later than within 90 days. We will replace the goods (subject to availability) or refund your payment at your option. Please note that you do not have the right to change your mind in respect of any sealed goods once they have been unsealed.

7.3 Section 9 (Refunds) sets out details of how and when refunds will be made.
8. Your statutory right to cancel
8.1 Exercising your right to cancel (Consumer Contracts Regulations 2013). For most goods bought online you also have a legal right to cancel your order within 14 days of delivery and receive a refund.
8.2 When you don't have the right to cancel. You do not have a right to cancel in respect of any sealed goods once they have been unsealed.
8.3 To cancel your order, please write a letter or send an email stating that you wish to exercise your statutory right to cancel, including your full name, address, and order number. Your item must be re-packaged securely and sent to us within 14 days of the date you notified us of your intention to cancel.
8.4 Please note that you will be responsible for the costs of returning the goods to us, unless we delivered items to you in error or the item is faulty. If you do not return the item within 14 days, we may either withhold the refund or arrange for collection of the item from you at your cost.
8.5 We reserve the right to deduct monies from refunds where the goods show signs of unreasonable use leading to diminished value.
8.6 Section 9 (Refunds) sets out details of how and when refunds will be made.
9.1 When we will pay the costs of return. We will pay the costs of returning the goods:
(a) if the goods are faulty or misdescribed; or
(b) if you are ending the contract because we have told you of an upcoming change to the goods or these terms, an error in pricing or description, a delay in delivery due to events outside our control or because you have a legal right to do so as a result of something we have done wrong.
In all other circumstances (including where you are exercising your right to cancel) you must pay the costs of returning the goods.
9.2 What we charge for collection. If you are responsible for the costs of return, and we are collecting the goods from you, we will charge for collection. The costs of collection will be the same as our charges for Next Day delivery service, see our Delivery page for details.
9.3 How we will refund you. We will refund you the price you paid for the goods, including delivery costs, by the method you used for payment. However, we may make deductions from the price, as described below.
9.4 Deductions from refunds if you are exercising your right to cancel. If you are exercising your right to cancel:
(a) We may reduce your refund of the price (excluding delivery costs) to reflect any reduction in the value of the goods, if this has been caused by your handling them in a way which would not be permitted in a shop. See our Returns page for information about what handling is acceptable and examples]. If we refund you the price paid before we are able to inspect the goods and later discover you have handled them in an unacceptable way, you must pay us an appropriate amount.
(b) The maximum refund for delivery costs will be the costs of delivery by the least expensive delivery method we offer. For example, if we offer a premium delivery service at a higher cost, then we will only refund what you would have paid for the cheaper delivery option.
9.5 When your refund will be made. We will make any refunds due to you as soon as possible. If you are exercising your statutory right to cancel then:
(a) If we have not offered to collect the goods, your refund will be made within 14 days from the day on which we receive the goods back from you or, if earlier, the day on which you provide us with evidence that you have sent the goods back to us.
(b) In all other cases, your refund will be made within 14 days of your telling us you have changed your mind.
10. Undelivered Items.
10.1 If an item fails to arrive with you after being dispatched by ourselves we have to wait for a period of 15 working days (10 working days for next day delivered items) from the date of dispatch before we can offer a refund or redelivery of that item. This is due to the fact our couriers will not consider an item lost until this point, so it is still likely that the item will still arrive.
10.2 If the item doesn’t arrive within this period, we will ask you to sign and return a form confirming that you have not received your order before we process a refund or a re-delivery.
10.3 Please note that any non-delivered items must be reported to us in writing or email (details which can be found in clause 7.3) within 10 days of dispatch. Any issue reported to us outside of this time period will not be able to be refunded or replaced.
11. Price and payment.
11.1 Where to find the price for the goods. The price of the goods (which includes VAT) will be the price indicated on the order pages when you placed your order. We take all reasonable care to ensure that the price of the goods advised to you is correct. However please see clause 11.3 for what happens if we discover an error in the price of the goods you order.
11.2 We will pass on changes in the rate of VAT. If the rate of VAT changes between your order date and the date we supply the goods, we will adjust the rate of VAT that you pay, unless you have already paid for the goods in full before the change in the rate of VAT takes effect.
11.3 What happens if we got the price wrong. It is always possible that, despite our best efforts, some of the goods we sell may be incorrectly priced. We will normally check prices before accepting your order so that, where the price of the goods at your order date is less than our stated price at your order date, we will charge the lower amount. If the price of the goods at your order date is higher than the price stated to you, we will contact you for your instructions before we accept your order. If we accept and process your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mis-pricing, we may end the contract, refund you any sums you have paid and require the return of any goods provided to you.
11.4 When you must pay and how you must pay. We accept payment with VISA, Maestro, Master Card, American Express, PayPal and Klarna which:
(a) for goods, you must pay for before we dispatch them. We will not charge your credit or debit card until we dispatch the goods to you.
(b) for subscription services, you must pay for before we dispatch them. We will not charge your credit or debit card until we dispatch the goods to you.
12. How we may use your personal information
13.1 Please note fragrances that have engraving/personalisation applied to them are not eligible for return or exchange.
13.2 In order to ensure your order is as expected, please make sure you check your message on-screen before submitting your order, that the message is correct (especially spelling) and as you intended.
13.3 All fragrance bottles that are eligible for engraving have pre-set positions where the engraving message is applied. We try to select the optimum position for your message.
13.4 We can only accept messages that contain letters and numbers, and cannot accept messages with special characters, symbols or any messages that may contain offensive or inappropriate language.
13.5 The engraving service is available on selected lines, and your fragrance bottle will be taken out of its original packaging (and outer plastic wrap will be removed) before the engraving process.
14. Personalised ribbon
14.1 Please note that gift wrap that has personalised ribbon applied to them are not eligible for return or exchange.
14.2 In order to ensure your order is as expected, please make sure you check your message on-screen before submitting your order, that the message is correct (especially spelling) and as you intended.
14.3 We can only accept messages that contain letters and numbers, and cannot accept messages with special characters, symbols or any messages that may contain offensive or inappropriate language.
14.4 The personalised ribbon service is available with gift wrapping only.
15. Personalised Greetings Cards
15.1 Please note that greeting cards with a personalised message are not eligible for return or exchange.
15.2 In order to ensure your order is as expected, please make sure you check your message on-screen before submitting your order, that the message is correct (especially spelling) and as you intended.
15.3 We can only accept messages that contain letters and numbers, and cannot accept messages with special characters, symbols or any messages that may contain offensive or inappropriate language.
16. Other important terms
16.1 We may transfer this agreement to someone else. We may transfer our rights and obligations under these terms to another organisation.
16.2 Nobody else has any rights under this contract. This contract is between you and us. No other person shall have any rights to enforce any of its terms except as explained in clause 16.1. Neither of us will need to get the agreement of any other person in order to end the contract or make any changes to these terms.
16.3 If a court finds part of this contract illegal, the rest will continue in force. Each of the paragraphs of these terms operates separately. If any court or relevant authority decides that any of them are unlawful, the remaining paragraphs will remain in full force and effect.
16.4 Even if we delay in enforcing this contract, we can still enforce it later. If we do not insist immediately that you do anything you are required to do under these terms, or if we delay in taking steps against you in respect of your breaking this contract, that will not mean that you do not have to do those things and it will not prevent us taking steps against you at a later date. For example, if you miss a payment and we do not chase you but we continue to provide the goods, we can still require you to make the payment at a later date.
16.5 Which laws apply to this contract and where you may bring legal proceedings. This contract is governed by English law and each party irrevocable agreed to submit all disputes arising out of or in connection with this contract to the exclusive jurisdiction of the English courts.
17. Scent Addict Subscription Terms
17.1 How does it work. In month 1, we send you an atomiser in black or white with an 8ml refill of your choice of sample fragrance, and subsequently we send you the 8ml refill of your sample fragrance choice each month thereafter (ensure you keep hold of your atomiser from your first delivery).
17.2 Your first sample fragrance should arrive with you within 10 working days of placing your subscription, with subsequent fragrance refills to follow each month around the day you placed your initial subscription.
17.3 Delivery. Once an order has passed all security checks, the order will generally be dispatched within 2 working days of being placed. An email confirmation will be sent to the email address you entered at the checkout to confirm dispatch. Orders generally take around 3 working days to arrive, but please allow for up to 10 working days for delivery.
17.4 Availability. Subscription services are only available in the UK and delivery is free on all subscription orders. Delivery of a one-off single Scent Addict purchase will be charged at our usual rates.
17.5 Subscription and gifting fees. Scent Addict offers a variety of subscription options. Current Scent Addict subscriptions (including gifting subscriptions) can be found here. Fees are dependent on which subscription or bundle you select. Payment is made by Mastercard or VISA.
17.6 You can also purchase subscription in store for a minimum period of 2 months, the cost of which is £24.00. On month 3, you will be charged £12 per month using the card you used to start your subscription in store.
17.7 Duration and cancellation. Please note that you are committing to the entire subscription duration. Therefore, unless you purchased your subscription online and cancel within 14 days from the date you receive your first subscription box, you will be tied into the subscription for the remainder of the subscription term you chose.
17.8 The subscription will automatically renew at £12.00 per month after the initial term, unless cancelled by you in accordance with your statutory rights or if you cancel up to 48 hours before your next order is submitted for dispatch of your next monthly subscription after the initial term.
17.9 Your statutory right to cancel. If you purchased your subscription online, you have until 14 days after the date you (or someone you nominate) receives the delivery of the first subscription box to change your mind. You do not have the right to cancel in respect of any used goods or a subscription purchased in store. You will be responsible for the costs of returning the goods to us and we reserve the right to refuse the return or to deduct monies from refunds where the good show signs of use leading to diminished value.
17.10 Lost items. If you believe an item is lost in the post, we cannot resend it or offer a refund until 15 working days after the date of dispatch. If you have an item which you believe is lost and today's date is more than 15 working days after dispatch, please email firstname.lastname@example.org stating your order number, email address and full name. Your query will be investigated with the courier and you will need to fill out a form. We cannot offer re-delivery or a refund until after the courier investigation is complete.
17.11 Damaged order. Please contact our Customer Services team within 24 hours of receipt of your order on 0161 468 7835. Please do not throw the packaging away as you may be asked to return it or take photographs of the damaged parcel/contents.
17.12 In order to update your subscription details, simply log into your account, then navigate to your subscription management account section. If you have forgotten your password, you will be able to re-set it.
18. Social Media Competitions
18.1. Entrants must be over the age of 18.
18.2. Entrants must live in the UK.
18.3. Entrants fully understand the consumption on the prize is for themselves only.
18.4. The prize is non-transferable.
18.5. There is a limit of one entry per person. Unless stated otherwise.
18.6 Winner(s) drawn at random within 7 days of the closing date. Winner(s) will be announced on the relevant platform in which they won the competition.
18.7 Winner(s) must claim their prize(s) within 14 days of announcement via direct message on the platform they won the competition. If they do not do so, then we reserve the right to offer the prize to an alternative winner.
18.8 Due to Covid-19, prizes for any competitions ran across social channels may take longer to be delivered.
18.9 If the winner(s) are not happy to comply with the above terms and conditions, then they forfeit their prize and The Fragrance Shop will therefore choose a new winner that complies with the above terms and conditions.
19. £100 e-gift card prize draw entry T&Cs
19.1 You will be opting in to our prize draw entry by providing your valid email address.
19.2 Anyone who does not provide a valid email address will not be entered.
19.3 One entry per person.
19.4 Closing date of prize draw is 29th February 2020 at 11.59pm and you must complete a full scentaddict survey to be entered.
19.5 A winner will be selected at random from the email addresses collected upon entry into prize draw. The winner will be contacted on 3rd March 2020 by 5pm (GMT) via the email address they provided. The winner has 14 days from the date the winning email is sent to respond to the winning email and to claim their prize by following the instructions in the winning email. If the winner does not respond within allocated time, they automatically forfeit the prize and we will pick a new winner on the same terms. The same rules apply until a winner responds and claims prize.
19.6 The e-gift card will be sent to the winner’s email address within 7 days of claiming the prize.
19.7 The £100 e-gift card prize is not redeemable against membership or subscription products and can only be used on The Fragrance Shop website www.thefragranceshop.co.uk. This e-gift card is non-transferable and cannot be exchanged for money.
20. My TFS Membership Terms
20.1 How does it work. My TFS is an annual membership service which gives you access to the benefits set out below. It is available in the UK only to anyone 18 years or older. If you purchase My TFS membership, you are requesting that we start providing you the service.
20.2 Benefits. As a My TFS member you will receive the following benefits:
(a) All Plans – My TFS, My TFS plus & My TFS family
(i) 20% discount on all eligible purchases up to the advertised limit on the membership plan selected.
(ii) Free Express Delivery for UK online orders.
(b) Selected Plans – My TFS plus & My TFS family
(i) Regular additional and/or exclusive member benefit for the duration of your membership as determined by us.
20.3 Delivery. Our Express Delivery Service uses Royal Mail UK standard delivery which is estimated to be delivered within 48-hours. Delivery timeframes are not guaranteed and are subject to external factors including product availability, your delivery address and specific cut off times. Delivery may also be delayed because of circumstances outside of our control (e.g. bad weather, strikes, no Sunday delivery) but we will do our best to update you where we can. 20.4 Exclusions. My TFS is only available in the UK. Changing or combining orders, or changing your delivery address, speed or preferences might affect your My TFS benefits eligibility. If only some items in your order are eligible for My TFS, you will pay full price or applicable delivery charges for the ineligible items. The discounting exclusions referred to in these terms also apply to any My TFS discounts. My TFS discounts cannot be used in conjunction with any other promotional offer. My TFS membership is not transferrable and cannot be exchanged for cash alternatives. My TFS cannot be used when purchasing Scent Addict, in Outlet stores or against Outlet products.
20.5 Fees and My TFS plans. Current My TFS fees and My TFS plans can be found here. My TFS fees are dependent on which My TFS plan you select. Once you have paid the My TFS fees you will be a member and will be able to access and use your My TFS benefits.
20.6 Payment. You will become a My TFS member upon paying the My TFS fees. We reserve the right to amend our fees at any time. If you have already made payment, the changes will not affect you until your next renewal.
20.7 Duration and cancellation. Each My TFS plan runs for 12 months starting from the date of purchase. Your My TFS membership will remain active and will renew annually and the current fee for your plan will be applied annually unless you tell us not to beforehand. You can cancel your membership in your My TFS account or by contacting our Customer Services team. Except as detailed below, My TFS fees are non-refundable. We reserve the right to refuse or cancel membership at our discretion.
20.8 Statutory right to cancel. If you have purchased My TFS online, you have the right to cancel within 14 days to receive a full refund if you haven’t used any of the benefits. If you have used any benefits, then we will keep what is necessary to cover the cost of the service provided. Any refund will therefore be reduced by the value of the benefit you have used. If the value of the benefit is higher than the My TFS fee, we will be unable to refund you. This does not affect your statutory rights.
20.9 Promotions and member benefits. When joining My TFS, you will be asked to provide your email address. We will contact you by email about your My TFS service to include details about your benefits, purchases, remaining discounts and any other relevant information. If you are subscribed to receive promotional emails from us, we may also send you marketing emails. You can choose to unsubscribe from those emails at any time.
